V posledných dňoch médiá začali v súvislosti s hlasovaniami v parlamente používať slovné spojenie zelená karta. Čo to je a kde sa vzala zelená karta?
Ako ste preukázali vo vašich článkoch a analýzach, strany, kluby a poslanci do neba volajúcim spôsobom porušujú ustanovenie čl. 73 ods. 2 Ústavy SR o slobodnom vykonávaní mandátu. Korunu tomu podľa mňa nasadila praktika, ktorá dostala meno zelená karta. Ukážka z médií: Predseda hnutia Sloboda a Solidarita (SaS) Richard Sulík sa stretne s poslancom Martinom Klusom (SaS) a bude s ním hovoriť o zelenej karte v rámci strany. Ako povedal Sulík novinárom, „strana SaS je veľmi tolerantná voči iným názorom, ja sa snažím SaS viesť maximálne tolerantne a pokiaľ mu na niektorých hlasovaniach mimoriadne záleží a má tam odlišný názor ako väčšina klubu, tak dostane zelenú kartu. Snažíme sa hlasovať rovnako, chcem, aby bola jednota, ale zas nie za takú cenu, že budem každého jedného poslanca pravidelne ‚znásilňovať‘.“ (webnoviny.sk)
Poďme si ukázať, aké obsahové bohatstvo sa skrýva v tomto krátkom vyjadrení pre médiá. Ktovie, či to bolo čaro okamihu, alebo si ho R. Sulík starostlivo pripravil, aby obhájil, čo je zjavne neobhájiteľné.
Takže, aj keď slobodu rozhodovania garantuje poslancom priamo ústava, predseda SaS veľkodušným gestom dovolí svojmu spolu straníkovi hlasovať podľa jeho svedomia a presvedčenia. Čo je to za nehoráznosť?! V akom vesmíre to R. Sulík žije?!
Čo sa za zelenou kartou vlastne skrýva
Nie je náhodou takéto vnímanie úplne pomýlené? Dve veci však zo Sulíkovho teatrálneho gesta jednoznačne vyplývajú. Po prvé, že kým neprestrihnete väzby na stranícke štruktúry, musíte znášať neslobodu (a tým pádom porušovať Ústavu SR). Po druhé, že sloboda udelená straníckym bosom R. Sulíkom stojí nad slobodou, ktorú garantujú zákony tohto štátu. Ahá, takže R. Sulík nie je len predsedom Slobody a solidarity, on je podľa všetkého predsedom slobody ako takej (SaT). Názov jeho strany sa v tomto kontexte začína javiť v úplne inom svetle, nemyslíte? Uznajte, aký ťažký musí byť život straníckeho bosa, keď sa z času na čas vyskytne v jeho tábore poslanec, ktorý svoju slobodu hlasovať obhajuje tak vehementne, že ho na poslušné hlasovanie treba znásilňovať. Veľmi šľachetné od R. Sulíka, že neznásilňuje každého jedného poslanca pravidelne, čo poviete?
(Ne)tolerancia
Ďalej, „SaS je veľmi tolerantná voči iným názorom…“. Bohužiaľ, ústavné právo poslancov rozhodovať sa pri hlasovaní podľa svojho svedomia a presvedčenia je už podľa všetkého za hranicou toho, čo je R. Sulík ochotný tolerovať. Mám dojem, že nám R. Sulík medzi riadkami vlastne hovorí, že existujú veci a názory, ktoré tolerovať nemieni. Aký paradox, že akurát strana Sloboda a solidarita sa neštíti okliešťovať slobodu svojich poslancov pri vykonávaní mandátu.
Ďalej, M. Klus „…dostane zelenú kartu… pokiaľ mu na niektorých hlasovaniach mimoriadne záleží a má tam odlišný názor“. Aj tu čítame dve veci. Po prvé, že iba na niektorých hlasovaniach záleží až tak, že sa poslanec dopustí iného názoru než zvyšok strany. Ostatné hlasovania sú asi menej významné alebo bezvýznamné, a tak znesú aj neslobodu. Po druhé, že právo poslanca mať odlišný názor negarantuje ústava, ale udeľuje ho stranícky bos. Nemusíte však mať stranu akurát so slobodou v názve, aby ste ju mohli garantovať, rovnako vám ju totiž vie udeliť aj B. Kollár alebo aj I. Matovič (pozri screenshot vyššie, článok na Košice dnes a na aktuality.sk). Zjavne je to teda výsada každého straníckeho bosa.
Sme, či nie sme ako oni
Dobre si pamätáme časy, keď sa Sulík, Matovič a Kollár aj so svojimi suitami pohoršovali pred voľbami hlavne nad tým, že SMERáci postavili svojich ľudí nad zákon. Prosím vás pekne, a čím sa oni od tých SMERákov líšia? Veď namiesto ústavy udeľujú slobodu poslancom oni, kedy uznajú za vhodné!
Čo je teda zelená karta? Nie je to nič iné než ďalší exemplárny príklad, ako bezočivo a bezhranične dokážu naši politici šliapať po slovenskej ústave a ďalších zákonoch. A kde sa vzala? V legislatíve určite nie, pretože je v príkrom rozpore so znením aj duchom príslušných ustanovení Ústavy SR a rokovacieho poriadku NR SR. Túto kartu vymysleli politickí inovátori, lebo sa im hodí. Práve oni neváhajú na svoje ciele prekrúcať a ohýbať zákony a svojim výtvorom dávať ešte aj eufemistické názvy, aby svoje nehorázne výmysly mohli verejnosti predať ako niečo vznešené, alebo dokonca vtipné.
Podľa mňa je čas na červenú kartu. Žltých už bolo habadej, pokúsme sa týmto politikom vystaviť definitívnu stopku.
